These Terms and Conditions (“Terms”) govern access to and use of CaseTrakr, available at https://casetrakr.com (the “Platform”), operated by CaseTrakr (“Company”, “we”, “us”, or “our”).

By accessing or using the Platform, creating an account, or purchasing a subscription, you agree to be bound by these Terms.

If you do not agree, do not use the Platform.


1. Description of the Service

CaseTrakr is a software-as-a-service (SaaS) platform designed to help organizations manage cases, including but not limited to immigration cases, study abroad programs, and similar workflows.

CaseTrakr does not provide legal advice, immigration advice, or professional consulting services. Users are solely responsible for how they use the Platform and for compliance with applicable laws.


2. Eligibility and Account Registration

You must:

  • Be at least 18 years old

  • Have authority to bind your organization (if registering on behalf of one)

  • Provide accurate and complete registration information

You are responsible for:

  • Maintaining account security

  • All activity under your account

  • Keeping login credentials confidential


3. Subscriptions, Billing, and Payments

3.1 Subscription Plans

Access to the Platform requires an active paid subscription unless otherwise stated.

Subscription details (pricing, billing cycle, features) are displayed on the website or checkout page.

3.2 Payments

Payments are processed through Stripe. By subscribing, you authorize us to charge your selected payment method on a recurring basis.

3.3 Renewals

Subscriptions automatically renew unless canceled before the end of the billing period.

3.4 Cancellations

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No partial refunds are provided.

3.5 Refunds

Unless required by law, all payments are non-refundable.


4. Acceptable Use

You agree not to:

  • Use the Platform for unlawful purposes

  • Upload false, misleading, or fraudulent information

  • Interfere with platform security or performance

  • Attempt unauthorized access to systems or data

  • Use the Platform to provide legal or immigration advice without proper authorization

We reserve the right to suspend or terminate accounts that violate these Terms.


5. User Data and Privacy

You retain ownership of your data.

By using the Platform, you grant us a limited license to store, process, and display your data solely to provide the Service.

Personal data is handled in accordance with our Privacy Policy, which complies with:

  • U.S. data protection laws

  • GDPR (EU)

  • Applicable LATAM regulations


6. Intellectual Property

All rights, title, and interest in the Platform, including software, branding, and content, belong to CaseTrakr.

You may not copy, modify, resell, or distribute any part of the Platform without written permission.


7. Service Availability & Support (Startup-Friendly SLA)

7.1 Availability

We aim to provide commercially reasonable uptime, but do not guarantee uninterrupted service.

Scheduled maintenance and unexpected outages may occur.

7.2 Support

Support is provided on a best-effort basis via:

  • Email

  • In-app support (if available)

We do not guarantee response or resolution times.

8. Third-Party Services

The Platform may integrate with third-party services (e.g., Stripe). We are not responsible for third-party outages, errors, or data handling.


9. Disclaimer of Warranties

THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE.”

WE DISCLAIM ALL WARRANTIES, INCLUDING:

  • MERCHANTABILITY

  • FITNESS FOR A PARTICULAR PURPOSE

  • NON-INFRINGEMENT

  • ACCURACY OR RELIABILITY OF DATA


10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

CASETRAKR SHALL NOT BE LIABLE FOR:

  • INDIRECT OR CONSEQUENTIAL DAMAGES

  • LOSS OF DATA

  • LOSS OF PROFITS

  • BUSINESS INTERRUPTION

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU IN THE LAST 12 MONTHS.


11. Indemnification

You agree to indemnify and hold harmless CaseTrakr from claims arising from:

  • Your use of the Platform

  • Your violation of these Terms

  • Your violation of applicable laws or regulations


12. Termination

We may suspend or terminate access:

  • For violations of these Terms

  • For non-payment

  • To comply with legal obligations

Upon termination, access to the Platform and data may be restricted or deleted.


13. Governing Law & Jurisdiction

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law principles.

Any disputes shall be resolved in courts located in Delaware, unless otherwise required by mandatory local law.


14. Changes to These Terms

We may update these Terms from time to time. Continued use of the Platform after changes constitutes acceptance.
